ANJANA MISHRA ORAL ORDER 18-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered under Sections 419, 420, 467, 468, 471, 472, 473, 474, 475, 476, 489(g), 311/34 and 120B of the Indian Penal Code. Learned counsel for the petitioner submits that the name of the petitioner came to be included in the FIR on the basis of confessional statement of co-accused, namely, Dharmendra Kumar before the police, who was arrested from the place of occurrence. It is further submitted that a gang was in operation at Bhupatipur where railway recruitment was made. It is also submitted that ,as alleged , on the basis of confessional statement made before the police, some incriminating articles including computer, application , answer sheet etc. were recovered, which

The name of the present petitioner also finds place in the confessional statement of the said Dharmendra Kumar. Learned counsel for the petitioner further submits that the petitioner is a government servant and has been continuously functioning. He further submits that as and when required in order to facilitate the investigation he shall make himself available before the Investigating Agency, so that there is no hindrance in the progress of the case.

In view of the facts and circumstances of the case and the petitioner is a government servant and no cogent material has been found in the case diary so as to place him for trial , let the above named petitioner, in the event of his arrest/surrender in the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/( ten thousand) each with two sureties of the like amount each to the satisfaction of Smt. Seems Kumari, learned Judicial Magistrate, Patna in Beur P.S.Case No. 233 of 2008,subject to the conditions as laid down u/s 438(2) Cr.P.C.

It is made clear that the petitioner shall appear before the court below on all dates and shall not absent from the Court on two consecutive dates. In case he fails to appear in the court below on two consecutive dates, without any reasonable cause, it

Patna High Court Cr.Misc. No.50881 of 2015 (5) dt.18-05-2016 3/3 shall be open to the court below to seek appropriate modification of order for cancellation of bail bonds. It is further directed that the petitioner shall also appear immediately after submission of charge sheet and accept the police paper.
