The petitioner is languishing in custody since 18.08.2018 in a case registered for the offence punishable under Sections 376 and 511 of the Indian Penal Code. The prosecution case is that the informant called the petitioner being his relative and electrician for getting an electric fan repaired when the petitioner made an attempt to ravish the informant.

It is submitted by learned counsel for the petitioner that maliciously the petitioner has been roped in the present case. In fact, the informant was not medically examined. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Patna High Court Cr.Misc. No.76525 of 2018(3) dt.01-02-2019 2/2 Learned APP for the State, after going through the case diary submits that the accusation is specific against the petitioner.

Considering the fact that the investigation has already been concluded and the accusation not being corroborated by the medical opinion, coupled with statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IV, Saharsa, in connection with Salkhua P.S. Case No. 167 of 2018.
