JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 08-08-2023 Heard Mr. Sanjay Kumar Mishra, learned counsel appearing on behalf of the petitioner and Mr. Rajeev Ranjan, learned counsel appearing on behalf of the State.

2. Learned counsel appearing on behalf of the petitioner submits that petitioner is the son of the deceased employee namely Late Suresh Kumar, who had died on 17.09.2018. The father of the petitioner was appointed as Prakhand Shikshak on 06.04.2007

Patna High Court CWJC No.5774 of 2023 dt.08-08-2023 2/3 under the "Bihar Panchayat Primary Teachers Rule, 2006" and died in harness on 17.09.2018. The mother of the petitioner had per-deceased of his father on 09.10.2007. The petitioner is aggrieved for non-payment of retiral dues payable to his deceased father.

3. Learned counsel appearing on behalf of the petitioner seeks to file detail representation with respect to his claim in the present writ petition for payment of retiral dues in accordance with law.

4. Considering the relief sought for by the petitioner, the District Programme Officer (Establishment), Katihar is directed to call for the entire records relating to the deceased employee namely Late Suresh Kumar, the father of the petitioner and from the Principal, Upgraded Middle School, Navgram, Barsoi, Katihar, the District Education Officer, Katihar as well as the Block Education Officer, Katihar.

5. On the basis of records the District Programme Officer (Establishment), Katihar must ensure payment of retiral dues to the petitioner within a period of six weeks from the date of filing of representation along with statutory interest on account of delayed payment.

6. In case of failure, the petitioner is free to take appropriate legal action against the concerned respondent.

7. With the above observation and direction the writ petition stands disposed of.
