JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 365, 366(A)/34 of the Indian Penal Code and later on, converted under Sections 372, 376, 406, 420, 467, 471, 120(B) of the Indian Penal Code, Sections 3, 4, 5, 6(A), 7/9 of Immoral Traffic Act and Section 6/7 of POCSO Act.
The statement of victim was recorded under Section 164 of the Cr.P.C. and the aforesaid statement goes to show that entire allegation centres around against Vikash @ Fuleshwar Paswan. So far as petitioner is concerned, he was working as Manager in a hotel in which the victims had been made captive
Patna High Court Cr.Misc. No.40409 of 2016 (2) dt.29-09-2016 2/2 and the victims had only stated against the petitioner that when they requested the petitioner to get the door open, petitioner refused to open the door on pretext that he had no keys of the aforesaid door.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Samastipur in connection with Tajpur (Halai O.P.) P.S. Case No. 127 of 2016.
