JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 The petitioner seeks regular bail in connection with Harsidhi P.S. Case No. 303 of 2018, registered for offences punishable under Sections 413 and 414 of the Indian Penal Code.
Allegation as per F.I.R is that the police on secret information, reached at Dakhawa Bargajawa and two persons seeing the police tried flee away from the motorcycle, however, they were apprehended and when asked to show the papers of the motorcycle, they could not produce the same. Apart from that it appears that petitioner is an accused in three other cases. It has been submitted on behalf of the petitioner that he has falsely been implicated at the instance of the police and in fact nothing has been recovered from the possession of the petitioner and further though there is recovery of motorcycle
Patna High Court Cr.Misc. No.74869 of 2018(2) dt.21-12-2018 2/2 from the possession of the petitioner, however, there is nothing on record to show that the recovered motorcycle is stolen one. Further he has been in judicial custody since 25.07.2018. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Harsidhi P.S. Case No. 303 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
