JUSTICE RAKESH KUMAR ORAL ORDER 01-12-2016 Heard Sri Pramod Mishra, learned counsel for the petitioner and Sri Amitesh Kumar, learned Addl. Public Prosecutor.
In this case, earlier by order dated 30.09.2016, a report was called for regarding stage of the case, which has been received and kept at Flag-X. The report suggests that out of seven chargesheeted witness, five have already been examined and only two witnesses are to be examined.
In view of the fact that the case is at the fag end, there is no reason to extend the privilege of bail. The prayer for bail stands rejected.
Keeping in view the fact that the petitioner is in custody since long, it is desirable to direct the court below to take
Patna High Court Cr.Misc. No.40882 of 2016 (3) dt.01-12-2016 2/2 all steps for early conclusion of the trial.
Let a copy of this order be sent to the concerned Superintendent of Police for ensuring production of remaining two witnesses, as and when required by the trial court. With above observation, the petition stands dismissed.
