The petitioner seeks bail in Gogari P.S. Case No. 217 of 2016, instituted for the offence under Section(s) 395 of Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. He further submits that petitioner in all the cases as mentioned in paragraph-3 of the bail petition, is on bail. The First Information Report is against unknown. No Test Identification Parade has been held. There is no recovery from possession of the petitioner. The name of petitioner has come in the confessional statement of co-accused Noor Alam.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Khagaria, in connection with Gogari P.S.
