====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-09-2020 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Petitioner is in custody in connection with Ballia P.S. Case No. 233 of 2019 for the offence under section 120B of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

In the instant case total 161.62 liters of illicit wine was seized.

The petitioner is in custody since 19.2.2020. Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner subject to the condition that the petitioner shall deposit Rs.

Patna High Court CR. MISC. No.24872 of 2020(2) dt.28-09-2020 2/2 50,000/- cash in the court below and on depositing of Rs. 50,000/- the court below shall release the petitioner named above on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cumSpecial Judge,Excise, Begusarai, in connection with Ballia P.S. Case No. 233 of 2019.

Deposit of Rs. 50,000/- shall abide by final outcome of the pending criminal case.
