JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 18-04-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as the learned APP for the State.

The petitioners apprehend their arrest in connection with Delha P.S. Case No. 231 of 2020, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 308, 504, 506 and 509 of the Indian Penal Code.

As per allegation, the accused persons badly assaulted the members of the informant side. The allegation against petitioner No. 1 is that he assaulted the uncle of the informant namely Dinanath Yadav with iron blade on his head. Co-accused Shiva, petitioner No.3

Patna High Court CR. MISC. No.30625 of 2021(3) dt.18-04-2022 2/2 and co-accused Satish also assaulted him with lathi. Learned counsel for the petitioners has submitted that there is case and counter case and members of the petitioner side have also sustained injuries.

The injury report of injured persons have been called for including injured Dinanath Yadav, which shows that all the injuries are simple in nature caused by hard and blunt substance. Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Gaya, in connection with Delha P.S. Case No. 231 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
