The sole petitioner, who is in custody since 27.07.2016 in Chhatauni P.S. Case No.185 of 2016( G.R. Case No.3682/2016) corresponding to N.D.P.S. Case No.39/2016 registered for the offence under Sections 20(b), 22, 23 and 24 of the N.D.P.S. Act, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that the petitioner was apprehended on an allegation that he along with other three accused persons were inhaling Ganja and from possession of other accused person 1 Kg. 500 gms material like Ganja was recovered. By way of referring to the statement

Patna High Court Cr.Misc. No.43390 of 2016 (2) dt.13-12-2016 2/2 made in paragraph-3 of the petition, learned counsel for the petitioner submits that the petitioner is having clean antecedent. Keeping in view the lesser quantity of Ganja, nature of accusation and clean antecedent of the petitioner, let the petitioner, namely, Manoj Kumar be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, East Champaran at Motihari in connection with N.D.P.S. Case no.39 of 2016 arising out of Chhatauni P.S. Case No.185 of 2016( G.R. Case No.3682/2016).
