====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 06-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Sirdalla P.S. Case No. 38 of 2008, instituted for the offence under Section(s) 302 and 201/34 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no eye witness to the occurrence.

It is alleged in the written report that informant who is Chowkidar has found one dead body lying near Barki Ahar situated half K.M. of south Kasiyadih. The villagers had assembled there. They could not identify the dead body. During investigation, the police has raised suspicion against petitioner as mentioned in paragraph-53 of the case

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Sirdalla P.S. Case No. 38 of 2008, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
