JUSTICE SUDHIR SINGH ORAL ORDER 16-02-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are languishing in custody since 25.10.2016 in connection with Sigori P.S. Case No. 104 of 2016 for the offences instituted under Sections 447, 341, 323 and 302/34 of the IPC.

The prosecution story, in brief, is that the FIR named accused persons came at the house of the informant and during course of scuffle, accused persons assaulted the father of the informant and pressed his neck as a result of which he died. It has been submitted on behalf of the petitioners that the petitioners are in custody since 25.10.2016 and the charge sheet

Patna High Court Cr.Misc. No.104 of 2017 (2) dt.16-02-2017 2/2 has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioners. General and omnibus allegation has been made against the petitioners. As per the postmortem report, the informant's father died due to cardiac respiratory failure.

On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Danapur, Patna, in connection with Sigori P.S. Case No. 104 of 2016.
