The Petitioners apprehend their arrest in Trial No. 2431 of 2016 arising out of Madhuban P.S. Case No. 230 of 2015 registered for the offences punishable under Sections 147, 148, 448, 341, 323, 325, 354(B) and 307 of the Indian Penal Code.
Petitioner No. 1 is the agent of Bajaj Allianz Company whereas petitioner no. 2 is the father of petitioner no. 1. Learned counsel for the petitioners submits that the petitioner No. 1 is the agent of Bajaj Allianz Insurance Company and deposited
Patna High Court Cr.Misc. No.22861 of 2017 (2) dt.06-06-2017 2/2 1st Installment of the insurance premium of the insurance of the father of the informant. The submission of the informant that the petitioners have deposited the second installment is false. Petitioners have got no criminal antecedent. One of the coaccused has been granted bail by a co-ordinate bench of this Court vide order dated 10.11.2015 in Criminal Miscellaneous No. 48905 of 2015.
Considering the aforesaid facts and circumstances of the case, let the petitioners named above in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IV, Motihari, East Champaran, in connection with Trial No. 2431 of 2016 arising out of Madhuban P.S. Case No. 230 of 2015 corresponding to Complaint Case No. 443 of 2015; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
