Petitioner is languishing in judicial custody since 05.11.2018 in connection with Goreakothi P.S. Case No. 222 of 2018 for offences punishable under Sections 420, 467, 468, 471, 414, 489(A)(B)(C)/ 34 of the Indian Penal Code. The prosecution case, as lodged by the police personnel, is that during course of vehicle checking a motorcycle with three persons including the petitioner were apprehended. On demand, they could not produce any paper relating to the said motorcycle. On search, from the possession of the petitioner two fake currency notes of 500 denomination and 200 denomination was recovered. From the possession of co-accused Ranjit Sharma two fake currency notes of 200

Patna High Court CR. MISC. No.21775 of 2019(2) dt.10-04-2019 2/2 denomination and from the possession of Mannu Kumar Dubey two fake currency notes of 200 denomination was recovered. Accordingly, a seizure-list was prepared.

It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and the currency notes were given by one Ankit Kumar Dubey, they did not know that it was a counterfeit note. He submits that Section 489(A) is bailable and one of the co-accused apprehended along with the petitioner has since been granted the privilege of bail by a coordinate Bench of this Court in Cr. Misc. No. 20103 of 2019 vide order dated 02.04.2019.

However, learned APP for the State opposes the prayer for bail.

Considering the nature of offence, period of custody and the allegations made in the FIR, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Siwan, in connection with Goreakothi P.S. Case No. 222 of 2018.
