JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-11-2016 Since both the cases arise out of Vaishali P.S. Case No.150 of 2016, they have been heard together and are being disposed of by this common order.

Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Section

Patna High Court Cr.Misc. No.40679 of 2016 (3) dt.22-11-2016 2/3 394 of the Indian Penal Code and subsequently, Sections 395/412 of the I.P.C. were also added.

The name of the petitioners came in confessional statement of co-accused and after that some looted articles are said to have been recovered from the godown of the petitioner in Cr. Misc. No.40679 of 2016.

Submission on behalf of the petitioner in Cr. Misc. No.40679 of 2016 is that petitioner was not aware of this fact that seized articles were of looted property and moreover, petitioner does not have any criminal antecedent.

Learned counsel appearing in Cr. Misc. No.43620 of 2016 submits that neither petitioner is named in the first information report nor anything has been recovered from his conscious possession.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let petitioners above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Vaishali at Hajipur in connection with Vaishali P.S. Case No.150 of 2016.
