Petitioner is apprehending arrest in connection with Pipra P.S. Case No. 426 of 2019 for the offence under sections 272/273/308/34 of the Indian Penal Code and Sections 30(a)/41(i) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that petitioner in the instant case total 9460.8 liters of India Made Foreign Liquor was seized from the truck bearing No. HR-567731. It is alleged that the liquor belongs to the petitioner. Learned counsel for the petitioner submits that the petitioner is neither owner nor driver of the truck. He submits that the liquor does not belong to this petitioner. Considering the aforesaid submission, the Court is

Patna High Court CR. MISC. No.25845 of 2020(2) dt.14-10-2020 2/2 inclined to grant anticipatory bail to the petitioner subject to the condition that the petitioner has to deposit Rs. 5,00,000/- cash in the court below and on deposit of Rs. 5,00,000/- the court below shall release the petitioner named above, on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from the date of communication of this order, on furnishing bail bond of Rs. 5,00,000/- (Five lacs) with two sureties of the like amount each to the satisfaction of learned 9th Additional Sessions Judge cum Special Judge, Excise, East Champaran, Motihari, in connection with Pipra P.S. Case No. 426 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C.
