The trial Court is directed to expedite the trial of the petitioner namely, Raja Kumar and conclude the same at the earliest.
So far as petitioner Ritik Singh is concerned, he has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 307, 302 of the Indian Penal Code and Sections 225(1-b)a, 26, 27, 35 of the Arms Act.
As per prosecution case, the petitioner along with coaccused Raja Kumar is alleged to have shot fire upon the informant due to which he sustained injuries. Female members of the petitioner along with co-accused namely, Ravi & Raj assaulted the brothers of informant Deman & Sagar by means of sharp weapon due to which Sagar sustained injuries and Deman Singh died.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to village rivalry. This case is counter case of Ara Town P.S. Case No. 925 of 2022. From perusal of case diary as well as FIR, it appears no specific overt-act of assaulting to the deceased Deman Singh against the petitioner. The petitioner is alleged to have assaulted the
Patna High Court CR. MISC. No.23462 of 2023(5) dt.31-08-2023 3/3 informant/Abhishek Kumar Singh whose injury report shows that he was treated in a private hospital which is not believable. The petitioner has got no criminal antecedent as stated in para-3 of the bail petition. It is further submitted that the petitioner is languishing in judicial custody since 11.11.2022. Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner namely, Ritik Singh is directed to be released on bail in connection with Town P.S. Case No. 926 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara.
