The petitioner seeks bail in connection with Mashrakh P.S. Case No. 245 of 2018 instituted for the offence under Section(s) 399 and 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.
In the written report, it is alleged that police, during patrolling and checking of vehicles, found 8- 9 boys standing beside the road on three motorcycle. Having seen the police vehicle they tried to flee away . Police arrested those persons which include this petitioner. It is further alleged that one country made pistol and two live cartridges has been recovered from possession of this petitioner. Thereafter, police recorded confessional statement of this petitioner.
Patna High Court Cr.Misc. No.74443 of 2018(2) dt.13-12-2018 2/2 It has been submitted that police merely on suspicion has implicated this petitioner in the instant case. Petitioner is in custody since 20.7.2018.
Keeping in view the period of custody already spent by petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Saran at Chapra in connection with Mashrakh P. S. Case No. 245 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioner.
