JUSTICE ARUN KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in connection with Sheohar P.S.Case No.218 of 2015 registered under Sections 147, 148, 149, 341, 342, 323, 342,323, 325, 379, 307, 302, 120(B) of the Indian Penal Code.

The allegation is that the petitioner along with Shaifullah Khan and his associates assaulted with rod while the deceased was going on road by a motorcycle.

Learned counsel appearing for the petitioner submits that the allegation is false and concocted. He further submits that the informant's son died due to road accident and after seven days of the accident the petitioner has falsely been implicated in this case. No post mortem was done of the deceased and cremated by

Patna High Court Cr.Misc. No.54158 of 2016 (2) dt.21-12-2016 2/2 the family members. Another co-accused, Shaifullah Khan, was granted bail by a coordinate bench of this Court vide order dated 08.12.2016 in Cr. Misc. No. 52354 of 2016 and the case of the petitioner stands on similar footing.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sheohar in connection with Sheohar P.S.Case No. 218 of 2015.
