This is an application for grant of regular bail for offences punishable under Section 399 and 402of the Indian Penal Code and Section 25(1-b)A, 26(i), (ii) & 35 of the Arms Act. It has been submitted on behalf of the petitioner that only allegation against the petitioner is of recovery of five live cartridges and so far allegation of recovery of pistol is concerned, the same is against the other co-accused person and he has remained in custody for more than two months. Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.54741 of 2016 (2) dt.20-12-2016 2/2 two months, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -IV, Munger, in connection with East Colony P.S. Case No. 47 of 2016, with the condition that One of the bailors will be his family members, having sufficient immovable property within the jurisdiction of the concerned court and petitioner will cooperate in the trial or investigation And shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
