The petitioner seeks regular bail in connection with Mashrakh P.S. Case No. 149 of 2019 instituted for the offences under Sections 147, 148, 149, 341 and 302 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 24.02.2021, charge-sheet has been submitted in the case and is a person with clean antecedent. Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that specific allegation of assault is against co-accused Mahesh Manjhi who is alleged to have dragged the informant's father and thrown him on the floor.

No.32855 of 2021(2) dt.29-11-2021 2/2 Learned counsel for the petitioner submits that in fact the victim died on account of old age as the injury report does not find any external injury on the body of the deceased. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 24.02.2021, no external injury on the deceased has been found, charge-sheet has been submitted in the case, the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- VI, Saran in connection with Mashrakh P.S. Case No. 149 of 2019 subject to the condition as laid down under Section 437 (3) Cr.P.C.
