Petitioner, Sarvesh Singh, is in custody since 08.11.2016 in connection with Town (Kadirganj O.P.) P.S. Case No. 654 of 2013/ G.R. No. 770 of 2013 registered under Section 135 of the Indian Electricity Act.

Allegation against the petitioner is of causing loss to the Government Exchequer of Rs. 205698/- by way of illegal electricity use.

Learned counsel for the petitioner has submitted that the petitioner is a farmer and he has never owned and possessed any industry and also he has falsely been implicated in this case due to local dirty politics, for which, he has been languishing in judicial custody since 08.11.2016. Further, it has been submitted on behalf of the petitioner that the alleged recovery does not belong to the petitioner.

Learned A.P.P. for the State has submitted that loss of Rs. 205968/- has been caused to the Government Exchequer through the electricity theft.

Considering the facts and circumstances of the case and the nature of allegation, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Electricity, Gaya in connection with Town (Kadirganj O.P.) P.S. Case No. 654 of 2013/ G.R. No. 770 of 2013.
