2. The petitioner has preferred this application for grant of regular bail in connection with Barachatti P.S. Case No. 234 of 2024 registered for the offences punishable under Section 392 of the Indian Penal Code.

3. As per the prosecution story, the informant has alleged that when he was going bank for the purpose of depositing an amount of Rs. 52,050/- by his motorcycle, three unknown miscreants overpowered him and snatched his bag in which the cash was carried as well as a Tab and other documents on gun point.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. His name has been figured in this case only on the confessional statement of one Anil Kumar made before the police who has

Patna High Court CR. MISC. No.21843 of 2025(2) dt.28-04-2025 2/2 been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 16399 of 2025 vide order dated 21.03.2025. Learned counsel further submits that petitioner is in custody since 09.01.2025 and charges have already been framed.

5. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

6. Keeping in view the aforesaid facts and considering the period under custody, let the petitioner, above named, be released on bail after framing of charge, (if not framed) on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, - 2nd Sherghati at Gaya in connection with Barachatti P.S. Case No. 234 of 2024 subject to the following conditions :- (i). Petitioner will remain physically present in trial on each and every date till the disposal of the case failing which, on two consecutive dates without reasonable cause, the bail bond of the petitioner may be cancelled by the Trial Court.
