JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-10-2020 Heard learned counsel for the petitioner as well as learned counsel for the State through video conferencing. The petitioner apprehends arrest in a case registered for the offence punishable under section 307 and other ancillary sections of the Indian Penal Code.

It is alleged that when the police, acting on a secret information that illicit liquor is being sold, raided a house in the village, FIR named accused persons and other about 100 unknown people of the locality started pelting bricks and stone on the police party causing injuries to three police men. Lawless mob also damaged the Government vehicles.

Learned counsel for the petitioner submits that the petitioner is innocent. He submits that the petitioner is a poor Auto driver and on the relevant day, he was at his Sasural which is almost 20 kilometers away. FIR is against three named and about 100 unknown people and the petitioner has been roped in this case merely on suspicion and no specific allegation has been levelled against him. It is stated in paragraph 3 of the bail petition that the petitioner has got no criminal antecedent. In the facts of the case, prayer for bail of the petitioner

Patna High Court CR. MISC. No.25096 of 2020(2) dt.14-10-2020 2/2 is allowed. In the event of arrest/surrender within a period of eight weeks, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Ganga Bridge Police Station Case No. 191 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
