Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Gopalpur P.S. Case No. 381 of 2022 dated 03.08.2022 registered for the offence punishable under Section 392 of the Indian Penal Code. 3.

The main submissions advanced by learned counsel for petitioner are that the petitioner is a very young person and has been languishing in jail since 23.12.2022 and against him there is no criminal antecedent and he has been dragged in this case merely on account of being brother of the co-accused Deepak Yadav, though as per CCTV footage collected by the police during investigation the petitioner was seen going with coaccused Deepak Yadav but except this there is no any other allegation against him and the alleged looted money as well as other articles of the informant were allegedly recovered from the

Patna High Court CR. MISC. No.23662 of 2023(2) dt.23-05-2023 2/2 almirah of the co-accused Deepak Yadav and not from the conscious possession of this petitioner and moreover, against the petitioner the investigation has been completed. Further submission is that both the parties have compromised this case and a compromise petition has been filed before the Court below.

Learned APP for the State opposes the bail prayer of the petitioner.

Considering the above submissions and mainly petitioner's young age and his fair and clean antecedent and the completion of investigation against him, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in connection with Gopalpur P.S. Case No. 381 of 2022.
