JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-04-2015 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

The petitioner is the husband of the deceased. The father-in-law of the petitioner i.e. father of the deceased Jagarnath Yadav is the informant of the present Bihiya P.S. Case No. 102 of 2014.

Learned counsel for the petitioner has submitted that it was out of sheer confusion that the First Information Report was instituted by the Informant and after having realized the actual

Patna High Court Cr.Misc. No.42337 of 2014 (3) dt.16-04-2015 state of affairs, the father of the deceased himself has resiled from his earlier version. He has submitted that even the affidavit of the present application seeking anticipatory bail has been sworn by the informant himself.

In view of the circumstances as noticed above, let petitioner above name, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in Bihiya P.S. case No. 102 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
