Petitioner is apprehending his arrest in connection with Sarai Ranjan P.S.Case No.143 of 2018, registered for offences punishable under Sections 498(A)/34 of the Indian Penal Code and Sections 3⁄4 of the D.P.Act.

Case relates to Section 498(A) of the IPC and on appearance of the O.P.no.2, the matter was referred to the Mediation Centre and the report of the Mediator is available at flag 'M', from which it appears that the matter was settled between the parties as one time settlement on payment of Rs.60,000/- , out of which Rs.15,000/- has already been paid by the petitioner and the rest of the amount he will pay in three

Patna High Court CR. MISC. No.20602 of 2019(5) dt.17-10-2019 2/3 equal installments by 20.2.2020 and on payment, both parties shall move before the learned Family Court for divorce on mutual consent.

Heard learned A.P.P. Both the parties have admitted the above facts..

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with a direction to the petitioner to surrender before the learned court below within a period of three weeks from the date of receipt of the order and on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-IV, Samastipur in connection with Sarai Ranjan P.S.Case No.143 of 2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that he has to pay rest of the amount as per the agreement reached between the parties before the Mediator and it is also expected that both the parties shall abide by the conditions as mentioned in the terms of the agreement before the mediator and signed by both the parties.

Patna High Court CR. MISC. No.20602 of 2019(5) dt.17-10-2019 3/3 Let a copy of the mediator report along with the terms of the agreement be sent to the learned court below for the needful.
