2. In this present case, the petitioner seeks bail in connection with Barhara P.S. Case No. 82 of 2024 registered for the offences under Sections 409, 406, 420 and 120(B) of the Indian Penal Code.
3. As per prosecution case, petitioner while working as Ward Member of Ward No.8 of Sohra Gram Panchayat along with co-accused Pintu Singh embezzled an amount of Rs. 32,11,504/- which was allotted for completing different schemes in the panchayat.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The allegations are general and

Petitioner was the Ward Member of Sohra Gram Panchayat and the FIR has been lodged after four years of alleged embezzlement at the instance of present Mukhiya. But this petitioner is 60 years old person and illiterate. It was the coaccused Pintu Singh who involved in completing the work and this petitioner has no knowledge as the documents were also kept by the co-accused. Co-accused Pintu Singh has been granted bail by a Co-ordinate Bench of this Court vide order dated 06.12.2024 passed in Cr. Misc. No. 64477 of 2024. Learned counsel further submits that all the works have been completed and some works have not been completed because some Raiyats raised serious objections to it and did not allow the road to cross through their lands. After investigation police has submitted charge-sheet. Petitioner is in custody since 27.06.2024. Petitioner is having clean antecedent.
5. Learned A.P.P. opposes the submission made on behalf of the petitioner. Learned APP submits that there is serious allegation of embezzlement of huge amount of Government money.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the clean antecedent of the petitioner along with his period of

No. 24762 of 2025(2) dt.30-04-2025 3/3 custody and submission of charge-sheet and also considering the grant of bail to similarly placed co-accused, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara/concerned court in connection with Barhara P.S. Case No. 82 of 2024, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
