The matter at issue is payment of admitted contractual dues of the petitioner to the tune of Rs.3,97,000/-. In compliance of the order dated 02.11.2010 passed by a Bench of this Court, the counter affidavit as also the supplementary counter affidavit have been filed on behalf of the respondent no.4 stating therein that the entire contractual dues of the petitioner have been paid and amount has been received by the petitioner.

The facts stated in the aforesaid counter affidavit as also supplementary counter affidavit have not been controverted by the writ petitioner by filing any rejoinder affidavit. In above view of the matter, this Court is of the opinion that the now the present matter has become infructuous as the admitted dues of the petitioner have already been paid by the respondents. Accordingly, the present writ petition stands dismissed as infructuous.
