1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Karpurigram Police Station Case No. 07 of 2025, dated 13.01.2025, disclosing offences punishable under Sections 126(2)/115(2)/329(4)/74/303(2)/3(5) of the Bhartiya Nyaya Sanhita, 2023.
3. The prosecution case, as per the First Information Report, is that on 02.01.2025 when the informant returned back from her farm land, the petitioner, along with other coaccused persons, entered into the house, started abusing and assaulting her. It has further been alleged that the petitioner torn the blouse of the informant and co-accused Aman Kumar, along with the petitioner, assaulted the

4. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to land dispute between the parties. Both parties are agnates. Except Section 74 and 303(2) of the Bhartiya Nyaya Sanhita, 2023, all other sections are bailable and Sections 74 and 303(2) of the Bhartiya Nyaya Sanhita, 2023 are super addition in the First Information Report. No injury has been caused to the husband of the informant.

Regards being had to the submissions advanced on behalf of the parties and taking into consideration the fact that both the parties are agnates, having land dispute and no injury has been caused to the husband of the informant, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Samastipur, in connection
