JUSTICE PRABHAT KUMAR JHA ORAL ORDER 17-05-2017 After some argument, the learned counsel for the petitioner seeks permission to withdraw this anticipatory bail petition as the prayer of petitioner for anticipatory bail was earlier rejected by this court vide order dated 11.11.2016 passed in Cr. Misc. No. 41121 of 2016.

Prayer is allowed.

This anticipatory bail petition is, accordingly, dismissed as withdrawn.

If the petitioner surrenders in the court below, i.e. learned A.C.J.M., Sherghati, Gaya in Sherghati (Dobhi) P.S. case No. 259 of 2016, the learned court below shall consider the prayer for regular bail of the petitioner on its own merit taking into consideration that petitioner is a lady.
