JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2017 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

This is an application for grant of regular bail for offences punishable under Sections 420 and 379 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that petitioners have not been named in the First Information Report nor there is any recovery from the possession of the petitioners. The petitioners' names surfaced during the course of investigation on the basis of confessional statement of co-accused and it is alleged that petitioners used to open the lock of mobiles and there is nothing against the petitioners so as to implicate them in the present case and they have been in judicial custody since

Considering the facts and circumstances of the case, period of detention and also the fact that petitioners' names transpired in this case only on the basis of confessional statement of co-accused, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Patna in connection with Pirbahore P.S. Case No. 263 of 2015.
