====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 30-04-2025 Heard Learned Counsel for the petitioner and Learned APP for the State.
2. The petitioner is apprehending arrest in connection with Ujiyarpur P.S. Case No. 303 of 2024 lodged on 05.11.2024, for the offence punishable under Section 310(2) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution, FIR has been lodged against unknown accused persons.
4. Learned Counsel for the petitioners submits that the petitioner is innocent and has committed no offence. His name has come in this case by virtue of confessional statement of the co-accused. He submits that nothing has been recovered from his possession and antecedent of the petitioner is clean.
5. Learned APP for the State opposes the prayer for
Patna High Court CR. MISC. No.23550 of 2025(2) dt.30-04-2025 2/2 bail of the petitioner and submits that the petitioner has moved here for anticipatory bail in the month of April, 2025 whereas in the month January itself, he was declared absconder.
6. As such, the prayer for anticipatory bail of petitioner is hereby rejected. However, in the event of surrender of the petitioner within four weeks from today, the prayer for regular bail shall be considered on the same day without being prejudiced by the order of this Court.
