The petitioner seeks bail in connection with Pawana P.S. Case No. 8/2023 registered for the offence under 37 of the Bihar Prohibition and Excise Act and Section 447/307/504/ 506/34 of the Indian Penal Code and 27 of the Arms Act. The petitioner is alleged to have threatened the informant in drunken state and also opened fire which crossed near the right ear of the informant.

Learned counsel for the petitioner submits that the petitioner is in custody since 23.01.2023 and he has been falsely implicated in this case due to dirty village politics. Learned Additional Public Prosecutor has vehemently opposed the prayer for bail.

Patna High Court CR. MISC. No.22848 of 2023(2) dt.15-05-2023 2/2 Considering the period of custody and the recovery of liquor, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after completion of one year in custody on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 1, Bhojpur at Ara in connection with Pawana P.S. Case No. 8/2023.
