JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 16-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner, apprehending his arrest in connection with Barhara P.S. Case No. 163 of 2014 registered under Section 409 of the Indian Penal Code, seeks privilege of pre-arrest bail.
Allegedly, the petitioner was working as Revenue Karamchari before his superannuation and he did not deposit the rent receipts nor he deposited the collected rent. The submission on behalf of the petitioner is of false implication and that the petitioner has already deposited the amount to the Department and even thereafter his pension was not processed then he had filed CWJC No. 18686/2013 and there
Patna High Court Cr.Misc. No.43177 of 2014 (2) dt.16-04-2015 2/2 was direction to the authorities for grant of pension and other retiral dues and as such, the petitioner deserves sympathetic consideration, a copy of the order passed in CWJC No. 18686/2013 has been annexed as Annexure-3/1.
As submitted, in the event of surrender or arrest within two months from the date of receipt/production of a copy of the order, the petitioner, Sheojee Rai shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur, Ara in connection with Barahara P.S. Case No. 163 of 2014, subject to the conditions laid down under Section 438(2) Cr.P.C (Jitendra Mohan Sharma, J) S.Pandey/- U
