JUSTICE SUDHIR SINGH ORAL ORDER 16-04-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Sohsarai P.S. Case No. 90 of 2013 registered for the offences under Sections 147, 148, 149, 188, 341, 337, 338, 353, 427, 120(B) of the Indian Penal Code and Section 3 of the Prevention of Damage to Public Property Act.

The prosecution case is that when the police official was preparing to send dead body of a lady died in motor vehicle accident for post mortem, the petitioner and other accused persons attacked upon the police party and started pelting stones, bricks and created obstruction in discharge of official duty and also damaged the government property.

Further it has been submitted on behalf of the petitioner that other co-accused in the present case, have been granted anticipatory bail, vide Annexure-2 series.

Considering the aforesaid facts, let the petitioner above named be released on bail in the event of arrest or surrender before the learned court below within a period of six weeks from today in connection with Sohsarai P.S. Case No. 90 of 2013 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Nalanda at Biharsharif, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
