Petitioner seeks bail in connection with Mehsi P.S. Case No. 126 of 2016 registered under Sections- 272, 273, 290/34 of the Indian Penal Code and section 47(A) of Bihar Excise Act.

Learned counsel for the petitioner submits that motorcycle from which recovery has been made does not belong to petitioner. It is further submitted that co-accused has been granted bail by this Hon'ble Court vide Cr. Misc. No. 41448 of 2016. It is further submitted that petitioner is in custody since 12.08.2016.

Considering the facts and circumstances of the

Patna High Court Cr.Misc. No.49353 of 2016 (2) dt.13-12-2016 case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, in connection with Mehsi P.S. Case No. 126 of 2016.
