====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 08-05-2026 Heard Mr.Vatsal Verma, learned counsel for the petitioner, learned counsel for the informant and the Mr.Chandra Bhushan Prasad, learned A.P.P. for the State.

2. The petitioner seeks bail, who is in custody since 11.11.2025 in connection with Jurawanpur P.S. Case No. 216 of 2025, F.I.R. dated 03.11.2025 registered for the offence punishable under Sections 137(2) B.N.S. Later on vide order dated 11.11.2025 Section 103(1)/238(a)/3/5 of B.N.S. was also added.

3. The FIR of the occurrence of murder is against unknown.

4. Learned counsel appearing for the petitioner submits that the petitioner is not named in the FIR. The name of

No.23279 of 2026(3) dt.08-05-2026 2/3 the petitioner has been transpired during investigation on the basis of the secret information as well as on the basis of CDR location. Thereafter the brother-in-law and sister-in-law of the deceased have stated that the deceased was last seen with the co-accused person namely, Raja Kumar and the petitioner. Learned counsel for the petitioner submits that except the aforesaid, nothing has come during investigation against the petitioner to suggest the involvement of the petitioner in the present occurrence.

Learned counsel for the informant and learned APP for the State, on the other hand, have vehemently opposed the prayer for bail of the petitioner and submits that on the basis of the confessional statement of the co-accused person and the petitioner, the dead body of the deceased was recovered, apart from that, the stab was used in the present crime in question was recovered, apart from that, the bail application of co-accused person namely, Raja Kumar has been rejected by this Court vide order dated 06.04.2026 passed in Cr. Misc. No.22254 of 2026.

6. Considering the nature of allegation against the petitioner and taking into account that, for the same set of allegation the bail application of the co-accused person namely, Raja Kumar has been rejected by this Court, I am not inclined
