The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 447, 387, 504 of the Indian Penal Code, Section 27 of the Arms Act and Section 17 C.L.A. Act. The allegation against the petitioner is of committing indiscriminate firing upon the informant with an intention to kill him.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 31.08.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. In course of occurrence, no one is said to have been injured. Hence, no offence under
Patna High Court Cr.Misc. No.52677 of 2016 (2) dt.16-12-2016 2/2 Section 307 of the Indian Penal Code is made out against the petitioner. The other co-accused has been granted bail vide Annexure-2 to the present application.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad, in connection with Salaiya P.S.
