20.08.2020 Heard Mr. Sharda Nand Mishra, learned counsel for the petitioner and Mr. Uday Pratap Singh, learned APP for the State.

The petitioner seeks bail in connection with Paraiya P. S. Case No. 133 of 2019, dated 1.09.2019, which has been instituted for the offences under Sections 302, 307 and 34 of the Indian Penal Code.

The wife of the deceased has lodged the F.I.R. that she saw the petitioner and several others strangulating the deceased. When she reached the place of occurrence and tried to rescue her husband, she was warded off.

Later, the deceased was hung from a tree by means of a piece of cloth.

The learned counsel for the petitioner has submitted that there is no specific accusation against the petitioner and that he has been made accused in this case because of village politics. He has also submitted that the petitioner is 73 years of age and is in custody since 02.09.2019.

Regard being had to the nature of accusation, I am not inclined to grant bail to the petitioner. The prayer for bail is rejected.

This Court directs that the trial of the petitioner be expedited.
