The petitioner apprehends his arrest in connection with Basnahi P.S. Case No.20 of 2011 registered under Sections 307, 447, 504/34 and later on added Section 302 of the Indian Penal Code besides Section 27 of the Arms Act and Sections 3(x) of the S.C./S.T. Act, pending in the court of the Chief Judicial Magistrate, Saharsa.
The allegation against the petitioner is that the petitioner and the co-accused, Manish Kumar, armed with pistol came at the door of the informant, Nand Kishore Ram and on the instigation of the co-accused, Manish Kumar, this petitioner fired shot at the
Patna High Court Cr.Misc. No.41941 of 2014 (2) dt.16-04-2015 2/2 informant causing injury on his abdomen and other parts of the body. The informant was taken to Sonebarsha Raj Hospital from where he was referred to Saharsa Sadar Hospital for better treatment but the informant died in course of treatment. Having considered the facts and the circumstances of the case and nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected.
