JUSTICE BIRENDRA KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody in connection with Rajgir Police Station Case No. 137 of 2016 for offences punishable under Section 395 of the Indian Penal Code. The offence of Dacoity, alleged in the first information report, is against unknown.

Submission of the petitioner is that he is in custody since 9th August 2016, thereafter he was not put on T.I.P., nothing was recovered from his possession and only material at the time of his arrest, was confessional statement of the co-accused where the name of the petitioner transpired.

Learned counsel for the informant has opposed the

Patna High Court Cr.Misc. No.49523 of 2016 (2) dt.21-12-2016 2/2 prayer of the petitioner on the ground that on the confessional statement of the petitioner, certain incriminating articles were recovered from places mentioned by the petitioner. . Considering the aforesaid facts and circumstances, let the petitioner, Suraj Kumar @ Suraj Kewat, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Biharsharif, Nalanda/Successor Court in connection with Rajgir Police Station Case No. 137 of 2016.
