2. The petitioner makes a prayer for bail in connection with Siwan Mufassil P.S. Case No. 465 of 2025 F.I.R dated 22.06.2025 registered for the offences punishable under Sections 126(2), 118(1), 109, 3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

3. As per the prosecution case, on 21.06.2025 at about 09:00 P.M., while the son of the informant, namely Kundan Kumar Chouhan, was returning on motorcycle with Lalu Chouhan near Mirganj More, the petitioner Chandan Kumar Mali along with co-accused persons waylaid them and opened indiscriminate firing. Patna High Court CR. MISC. No.24820 of 2026(3) dt.13-05-2026 2/3 accused Mritunjay Chouhan fired from pistol causing bullet injuries to the son of the informant on his back and right hand. Thereafter, on alarm being raised by local people, all the accused persons fled away after extending threat of dire consequences.

4. Learned counsel for the petitioner submits that petitioner is innocent, has committed no offence and has falsely been implicated in this case. It is submitted that specific allegation of causing bullet injury is against Chandan Kumar Mali and Mrityunjay Chauhan, who have caused injury to the informant's son and Lalu Chauhan. Petitioner is in languishing in judicial custody since 09.01.2026. Moreover, a statement has been made in para 3 that the petitioner has one antecedent of Bengal Jua Act in which he is on bail.

5. Learned Additional Public Prosecutor for the State as well as learned counsel for the informant opposes the prayer for regular bail.

6. Considering the facts and circumstances and the period of custody, the petitioner is enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned Chief Judicial
