In the present case, the petitioner is seeking bail in N.D.P.S. Case No.04 of 2020 arising out of Brahampur (Krishna Brahm) P.S. Case No. 113 of 2020 registered for the offence punishable under Section 20/22 (c) of NDPS Act. The allegation against the petitioner is to have recovered 02 gram of heroin from his possession, however, counsel for the petitioner submits that the alleged recovery of 02 grams comes within the purview of small quantity for which punishment has been prescribed for one year and the petitioner is in judicial custody since 01.03.2020 having clean antecedent. Considering the facts and circumstances of the case,

No.21174 of 2020(2) dt.30-06-2020 2/2 the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of District Judge-cum-Special Court, N.D.P.S. Act, Buxar in connection with N.D.P.S. Case No. 04 of 2020 arising out of Brahampur (Krishna Brahm) P.S. Case No. 113 of 2020 with a further condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds. Further condition is that whenever the police will call the petitioner for the purposes of investigation and interrogation, he will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled.
