2. The petitioner makes a prayer for bail in connection with Birpur P.S. Case No.99 of 2024, F.I.R dated 24.05.2024 registered for the offences punishable under Section 302 and 34 of the Indian Penal Code and 27 of the Arms Act.
3. As per the prosecution case, on 27.05.2024 at about 1:00 P.M., Ayodhi Sahani took the informant's husband to play cards at the bamboo grove of Ram Babu Singh. Later, upon receiving information about a quarrel among the card players, the informant reached the spot and allegedly saw 5-7 persons assaulting her husband. It is alleged that Tulsi Sahani caught hold of him while the petitioner shot him on the forehead,
Patna High Court CR. MISC. No.24700 of 2026(3) dt.13-05-2026 2/3 causing his death, after which the accused persons fled away. The occurrence was allegedly witnessed by Gulshan Kumar, Dinesh Singh, Arvind Singh, Balram Kumar Singh and Manoj Kumar.
4. Learned counsel for the petitioner submits that pursuant to the order dated 16.04.2026, stage of trial in connection with Birpur P.S. Case No.99 of 2024 was called for from the Court concerned and report dated 28.04.2026 has been received and has been kept on record marked as "A" and from the said report, it appears that out of ten (10) prosecution witness in this case, six (6) prosecution witnesses have been examined and the evidence of four (4) witnesses are still to be adduced by the prosecution.
5. Learned Additional Public Prosecutor for the State opposes the prayer for regular bail and submits that other witnesses may be directed to be examined in a time line.
6. Considering the facts and circumstances and keeping in view the period of judicial custody of this petitioner, who is rotting in jail since 22.06.2024, it is expected that the remaining four witnesses be examined within a period of three months from today and in case such examination of the witnesses are not concluded then the petitioner shall be at liberty
Patna High Court CR. MISC. No.24700 of 2026(3) dt.13-05-2026 3/3 to renew the prayer for regular bail after an expiry of four months.
7. Accordingly, the regular bail application is disposed of in the above terms.
