JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 307, 452, 440, 449, 380 and 506 of the Indian Penal Code. The prosecution case is that 30 accused persons and others made association namely 'Krantikari Sangh' under the leadership of co-accused Nityanand Shukla when it is alleged that the accused persons came and claimed that the house of the informant's side was made on the Gairmajarua land. The accused persons entered into the house, robbed the articles and demolished the house and shop of the informant's side.

It is submitted by learned counsel for the petitioners that the accusation is against the mob. Moreover, for the same incident,

Patna High Court Cr.Misc. No.45083 of 2015 (2) dt.16-10-2015 2/2 two FIRs were lodged and in the other case being Nautan P.S. Case No. 215 of 2015, the petitioner has been granted anticipatory bail vide Cr. Misc. No. 45606 of 2015. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., West Champaran, Bettiah in connection with Nautan P.S. Case No. 216 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
