Heard learned counsel for the parties.
This application is for modification in the conditions granting bail to the petitioner in Cr. Misc. No. 44218 of 2019 on 18.07.2019.
16 litres of liquor was recovered when the petitioner allegedly threw it. Considering the criminal antecedent of the petitioner of identical nature, the Court had directed that the petitioner would be released if the trial is not concluded within six months from the date of framing of the charge. Learned counsel for the petitioner submits that one
Patna High Court CR. MISC. No.21030 of 2020(2) dt.21-07-2020 2/2 year has elapsed. However, charges have not been framed as the case is running for appearance of some other co-accused. Moreover, due to COVID-19 effects, the working of the trial court is not going on uninterruptedly.
Finding substance in the submission aforesaid, let the petitioner, above named, be immediately released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Pirbahor Police Station Case No. 270 of 2019. If the petitioner would not be in a position to produce sureties due to on going lockdown, the petitioner shall be released on his personal bond provisionally and the provisional bail bond shall be accepted after production of the sureties in due course.
