27-10-2016 Heard Sri Nityanand, learned counsel for the petitioner and learned Addl. Public Prosecutor . The sole petitioner, who is in custody since 12-08-2016 in G.R.P. (Patna Junction) P.S. Case No. 223 of 2016 registered for offence under Section 273 of the Indian Penal Code and Section 47(A) of the Bihar Excise Amendment Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner is a registered porter at Patna Sahib Railway Station and he has falsely been implicated on an allegation of recovery of 15 bottles containing 750 ml. each of Royal Stag Premier foreign liquor and 35 pouches of country-made liquor. By way of referring to statement made in paragraph - 3 of the petition, he submits that petitioner is having clean antecedent.

Patna High Court Cr.Misc. No.46247 of 2016 (2) dt.27-10-2016 2/2 Learned Addl. Public Prosecutor has opposed the prayer for bail.

However, keeping in view nature of accusation, period of custody and clean antecedent of the petitioner, let the petitioner namely Sunil Paswan @ Sunil Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Patna in connection with G.R.P. (Patna Junction) P.S. Case No. 223 of 2016.
