1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Bihpur (Jhandapur) P.S. Case No. 258 / 2023 dated 30.04.2023 registered under Sections 366, 366(A) of the I.P.C.

3. As per the first information report on 26.04.2023 the minor daughter of the informant went to market but did not come back and in the course of search the informant came to know that the petitioner kidnapped / abducted the minor daughter of the informant for the purpose of marriage.

4. Learned counsel for the petitioner submits that there was love relationship between the petitioner and the victim. The victim suo motu appeared in the court on 19.07.2024 and the Child Welfare Committee, Bhagalpur released the victim in favour of the petitioner and both are living as husband and wife. Patna High Court CR. MISC. No.21759 of 2025(2) dt.30-04-2025 2/2 on 13.06.2024. The Child Welfare Committee, Bhagalpur after being satisfied that the victim was major as on 19.07.2024 released the victim in favour of the petitioner and still both are living together.

Having heard learned counsel for the petitioner and the state and taking into consideration the fact that Child Welfare Committee, Bhagalpur after being satisfied that the victim was adult on 19.07.2024 released the victim in favour of the petitioner, as such, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- Ist Naugachia, District- Bhagalpur in connection with Bihpur (Jhandapur) P.S. Case No. 258 of 2023 subject to the condition as laid down under Section 482 (2) of the B.N.S.S., 2023.
