JUSTICE KHATIM REZA ORAL ORDER 03-05-2024 This modification application has been filed for modification of the order dated 05.03.2024 passed in Cr. Misc. No.80985 of 2023 by which the petitioner was granted anticipatory bail in connection with Sakra PS Case No. 400 of 2023.

2. Learned counsel for the petitioner submits that in the cause title of Cr. Misc. No.80985 of 2023 as well as in vakalatnama inadvertently name of the father of the petitioner as well as address has been typed as 'son of Ravindra Thakur, resident of village- Nawalpur Mishrauliya, P.S.- Sakra, DistrictMuzaffarpur' in place of "son of Baidhnath Sah, resident of village- Nayagaon, P.S.- Mushahari, District- Muzaffarpur" and the same mistake has occurred in the order dated 05.03.2024

Patna High Court CR. MISC. No.34178 of 2024(2) dt.03-05-2024 2/3 passed in Cr. Misc. No.80985 of 2023 by which the petitioner has been granted anticipatory bail as a result of which the petitioner could not surrender before the Court below. Learned counsel seeks permission to make necessary correction in cause title as well as in the vakalatnama of Cr. Misc. No.80985 of 2023 with regard to parentage and address of the petitioner.

4. Learned counsel for the petitioner is permitted to make necessary correction in the cause title as well as in the vakalatnama of Cr. Misc. No.80985 of 2023 with regard to parentage and address of the petitioner. Let the same be done in course of the day.

5. Accordingly, in the cause title of the order dated 05.03.2024 passed in Cr. Misc. No.80985 of 2023, in place of 'son of Ravindra Thakur, resident of village- Nawalpur Mishrauliya, P.S.- Sakra, District- Muzaffarpur' it should be read as "son of Baidhnath Sah, resident of village- Nayagaon, P.S.- Mushahari, District- Muzaffarpur".

6. Further, four weeks' time from the date of receipt/production of a copy of this order is granted to the petitioner to surrender before the Court below in terms of the order dated 05.03.2024 passed in Cr. Misc. No.80985 of 2023.
